NRC undertakes unlimited liability for damage arising from injury to life, body or health based on obligations violated by NRC, its statutory representatives or vicarious agents as well as for damage caused by the absence of a feature guaranteed by NRC or in the event of fraudulent behaviour on the part of NRC. NRC undertakes unlimited liability for damage caused intentionally or by gross negligence by NRC or by one of its statutory representatives or vicarious agents. In the case of violation of essential contractual obligations caused by minor negligence, NRC shall be liable to the sum of foreseeable damages with the exception of cases outlined in sentences 1 or 5. In abstract terms, essential contractual obligations are obligations, compliance with which permit proper performance of a contract and which the parties to the contract are entitled to rely on at regular intervals. This does not affect liability in accordance with the law governing product liability. The expiry period for claims for damages against NRC is one year with the exception of the cases outlined in sentences 1, 2 or 5.
